Vaccine Mandate Supreme Court 2022: How could the outcome affect you?


The first stage of the Biden administration’s vaccine-or-test mandate for employees at large companies began Monday.

The Supreme Court is expected to issue rulings, with an opinion on vaccine mandates for employers expected to be among them.

After last week, the Supreme Court appeared poised to reject the nationwide vaccination mandate for small businesses. However, according to Chicago attorney Karen Conti, “you never know how the Supreme Court is going to rule based on the arguments.”

The judges were skeptical about the requirements, but seemed more open to a mandate for healthcare workers than the vaccine rule for private companies with more than 100 employees.

“Sometimes they ask questions of each other and of the litigants, just to kind of play devil’s advocate,” Conti to The National Desk’s Jan Jeffcoat said. “They did express some real concern about the general mandate, the one that would mandate employers over 100 employees for their workers to get the vaccination, and the reason is that there’s just been no precedent for it.”

While a ruling from the judges occurs, the Occupational Safety and Health Administration began enforcing its rule for private companies on Monday, albeit on a limited basis.

Despite this, some state leaders are acting before the Supreme Court makes a decision.

How does the new rule impact?

Iowa Gov. Kim Reynolds announced Friday that the state labor commission had given notice that Iowa would not adopt or enforce the mandate.

“We are going to continue to protect the freedoms and liberties of Iowans,” Reynolds said in a statement. “The Biden Administration continues to ignore the constitutional rights afforded to all Americans, which our country was built on. Instead, they’d rather dictate health care decisions and eliminate personal choice, causing our businesses and employees to suffer and exacerbating our workforce shortage.”

The rule applies to an estimated 84 million people and requires employers with more than 100 workers to mandate vaccination or face weekly testing and a masking requirement.

In November, the 5th U.S. Circuit Court of Appeals temporarily halted the rule. But last month it was reinstated.
